In Spain, the most important question to put to any EOR is how it complies with the ban on illegal transfer of workers (cesiรณn ilegal de trabajadores, Article 43 of the Workers' Statute). Placing workers at another company's disposal is restricted outside licensed temporary work agencies (ETTs).

After that, look at how the provider applies collective agreements, handles Spain's mandatory time recording, and bills dismissal settlements, which can be substantial.

    Ask whether the provider employs through its own Spanish entity, a licensed ETT or another structure, and how it addresses Article 43.

    The applicable convenio colectivo can set pay floors, hours and extra payments. The provider should identify it before you make an offer.

    Daily working-time records are mandatory in Spain. Check the provider has a compliant system.
