Australia is straightforward for EOR hiring in most cases, but two local issues separate providers: labour hire licensing in Queensland, Victoria, South Australia and the ACT, and correct handling of modern awards, payroll tax and superannuation.
From July 2026, Payday Super also requires super to be paid with each pay run, so check providers have adapted their payroll.
- 1
Labour hire licences
If your employee works in QLD, VIC, SA or the ACT, ask whether the provider holds a licence there, or why one isn't needed.
- 2
Own Australian entity
Ask whether the provider employs through its own Australian company or a partner.
- 3
Award coverage and payroll compliance
The provider should check whether a modern award covers the role and apply its pay rates, overtime and loadings.
- 4
Payroll tax and super itemised
Ask which state's payroll tax applies, whether it's itemised in the quote, and that super is paid each pay run.
